GENERAL TERMS AND CONDITIONS OF USE

1. Introduction

Welcome to [JBUJB] (hereinafter the "Application"), a service that facilitates business discovery, table reservation, dish ordering and cashless payment. These General Terms and Conditions of Use (hereinafter "GT&C") define the rights and obligations of users of our platform.

By accessing the Application, you accept these GT&C as well as all associated policies. If you do not accept these conditions, please do not use our services.

2. Definitions

In these GT&C, the following terms shall have the following meaning:

  • "User": Any person using the Application to search for businesses, book, view the menu order dishes or make payments.
  • "Partner Business": Food establishment listed on the Application and offering its services through the platform.
  • "Order": Any purchase of service or product made by a user from a Partner Business.
  • "Payment Providers": Third-party services managing financial transactions on the Application.
  • "Account": User's personal space, necessary to use the Application services.

3. Access and Use of the Application

  • 3.1. Access to the Application is reserved for persons aged 18 and over.
  • 3.2. The user must provide accurate and up-to-date information when registering.
  • 3.3. The Application may be temporarily unavailable for maintenance or service improvement reasons.
  • 3.4. The User undertakes not to use the Application for illegal, fraudulent purposes or in breach of these GT&C.

4. Account Creation and Security

  • 4.1. The User must create a personal account by providing an email address, or a valid phone number and a secure password.
  • 4.2. The User is responsible for the confidentiality of their identifiers and any activity carried out from their account.
  • 4.3. In case of suspicion of fraudulent use, the User must immediately contact customer support.

5. Services and Features

5.1. The Application offers the following services:

  • Search for businesses based on various criteria.
  • View menus and prices.
  • Book tables directly through the platform.
  • Order dishes from Partner Businesses.
  • Secure online payment.
  • 5.2. Information about businesses is provided by them, and the Application does not guarantee its accuracy.
  • 5.3. The User accepts that orders are subject to the availability of Partner Businesses.

6. Pricing and Payment

  • 6.1. The prices displayed are defined by Partner Businesses and include all applicable taxes in accordance with the tax laws of the Kingdom of Morocco.
  • 6.2. Service fees may be applied and will be specified before payment validation.
  • 6.3. Payments are processed via third-party providers approved by Bank Al-Maghrib, and the Application does not store any banking information.
  • 6.4. In case of payment failure, the order will not be validated.

7. Cancellation, Modification and Refund

  • 7.1. Cancellation and modification conditions are defined by Partner Businesses and must comply with regulations in force in Morocco.
  • 7.2. No refund will be made in case of late cancellation, unless otherwise indicated by the business or under Moroccan consumer rights.
  • 7.3. Refunds, when applicable, will be made via the same payment method used when ordering and within the timeframes required by Moroccan legislation.

8. Application Liability

  • 8.1. The Application acts only as an intermediary between the User and the Partner Business.
  • 8.2. The Application does not guarantee the quality of services or compliance with delivery or preparation times.
  • 8.3. In case of dispute, the User must contact the business concerned directly. In case of non-resolution, the User may refer to the competent authorities in consumer protection in Morocco.

9. Personal Data Protection and Privacy

  • 9.1. The Application collects and processes data from Users and Partner Businesses in accordance with Law 09-08 on the protection of natural persons with regard to the processing of personal data.
  • 9.2. Information from Users and Partner Businesses is protected and will only be used for the proper functioning of the services offered.
  • 9.3. The User can access, modify or delete their data via their personal account and can exercise their rights regarding data protection with the CNDP (National Commission for the Control of Personal Data Protection).
  • 9.4. Data from Users and Partner Businesses is neither sold nor shared with third parties for commercial purposes, unless explicit consent or legal obligation.
  • 9.5. The Application implements security measures in accordance with market standards to protect personal information against any unauthorized access.

10. Intellectual Property

  • 10.1. All elements of the Application (logos, texts, images, interface) are protected by Moroccan laws on intellectual property.
  • 10.2. Any reproduction, distribution or unauthorized exploitation of the content is strictly prohibited.

11. Modifications to the GT&C

  • 11.1. The Application reserves the right to modify these GT&C at any time.
  • 11.2. The modifications will be communicated to Users by notification on the Application and must comply with legislation in force in Morocco.

12. Applicable Law and Dispute Resolution

  • 12.1. These GT&C are governed by the laws in force in the Kingdom of Morocco.
  • 12.2. In case of dispute, an amicable resolution attempt must be made before any legal action. In case of failure, the dispute will be brought before the competent courts of the Kingdom of Morocco.
